Master Ian Forrester in conversation with Master Eleanor Sharpston

It is not the case that Brexit will end the significance of EU law in the UK after January 2021.  Tens of thousands of EU legal texts have been adopted into UK law in anticipation of Brexit, so as to avoid leaving legal lacunae.  The topics range from pesticides to environmental protection to pensions and animal welfare and feed additives.  These texts have been drafted by diplomats and civil service experts who want to balance the diverging interests of different Member States.  They are often deliberately imprecise as to their meaning. 

Should a controversy regarding the interpretation of a rule on equality of remuneration between men and women be decided by bearing in mind EU legal principles and judgements of the courts in Luxembourg?  Should consistency with EU27 norms be relevant as an aid to textual interpretation? Should it be desirable or irrelevant or undesirable?  How and to what extent can EU principles of interpretation be invoked in English courts?  

A Judge and an Advocate General will review these vital questions in an informal discussion with fellow members of the Inn.

  2. Describe the possible role of the ECJ for UK law after January 2021.
  3. Recognise the significance of EU law in the UK after Brexit

This session will be of great public interest as it focuses on the legal relationship between the EU and the UK during Brexit. It is important to discuss such matters as there is the propensity for conflicting ideas or the misinterpreation of legislation that would greeatly impact the workings of both EU and UK courts.
