This talk by Master Graeme Mew offers an introduction to sports law with a particular focus on the resolution of sports disputes by specialist tribunals.

Sports law “[…] is a body of rules governing the practice of sport and the resolution of disputes in sport. That body of rules straddles the boundaries between many well-known branches of our law, but has at its centre an unusual form of international constitutional principle prescribing the limited autonomy of non-governmental decision making bodies in sport.” Beloff, et al., Sports Law, 2nd. Substantive topics will include the application of public law principles, the rise of legalism in the world of sport, the limited role of the courts, ethical issues in sport and the development of internationally recognised governing principles.

Learning Outcomes:

  1. Recognise the jurisdiction of sport dispute resolution bodies.
  2. Apply public law principles to the fair resolution of sports disputes.
  3. Distinguish between disputes (such as field of play decisions or criminal acts) which are not suitable for resolution by sport tribunals and those that are.
  4. Evaluate the balance between substantive justice and the demand for fast, cost-effective resolution of sport disputes

This lecture (and the discussion that follows it) will equip barristers with a familiarity with the national and international systems of sports tribunals that clients involved in sports disputes are likely to be governed by as well as the applicable legal principles and procedures employed in those tribunals.
