I n November 2023 the Court of Appeal in Churchill v Merthyr Tydfil considered whether the courts coul d order Alternative Dispute Resolution without the parties’ consent. On 1 October 2024 amendments we re made to the Civil Procedure Rules reflecting th e decision. \;This session will explore precis ely what Churchill decided and the rules provide\, how the courts are exercising their powers in rel ation to ADR and how we should advise clients as a result. \;
